ABA Code of Conduct

Code of Conduct Purpose -

The purpose of this code of conduct is to ensure a safe and positive environment by instituting a zero-tolerance policy. Alberta Basketball is committed to providing a sport environment in which all individuals are treated with respect and dignity. Individuals are expected to behave in an appropriate manner consistent with the values of the ABA, basketball and sport. Conduct that violates this code may be subject to disciplinary action. This code of conduct applies to conduct that may arise during the course of ABA business, activities and events, including but not limited to its office environment, competitions, practices, training camps, tryouts, travel and any meetings of the ABA.

Responsibilities - All individuals have a responsibility to:

1. Maintain and enhance the dignity and self-esteem of ABA members and other individuals by:

a. Demonstrating respect, regardless of body type, physical characteristics, athletic ability, gender, ancestry, colour, ethnic or racial origin, nationality, national origin, sexual orientation, age, marital status, religion, political belief, disability or economic status,

b. Focusing comments or criticism appropriately and avoiding public criticism of athletes, coaches, officials, organizers, volunteers, employees and members,

c. Consistently demonstrating the spirit of sportsmanship, sport leadership and ethical conduct,

d. Consistently treating individuals fairly and respectfully;

2. Refrain from any behavior that constitutes harassment, comment or conduct directed towards an individual or group, which is offensive, abusive, racist, sexist, degrading, or malicious; Refrain from any behavior that constitutes sexual harassment, where sexual harassment is defined as unwelcome sexual comments and sexual advances, requests for sexual favors, or conduct of a sexual nature; and

3. Comply at all times with the bylaws, policies, procedures, rules and regulations of Alberta Basketball.

ABA General Waiver and Permissions

In consideration of the individual whose name is set forth above (the “Participant”) being permitted by Alberta Basketball (“ABA”) to participate in any ABA tryouts, games, events, and activities related thereto (collectively the “Event”), Participant and if Participant is under the age of the majority in the province in which Participant resides, I  the parents or legal guardians of the Participant, on behalf of Participant, hereby: 

 1. Acknowledges that Participant’s participation in the Event involves risk of serious bodily injury, death, property damage and/or other harm which might result not only from the Participant’s actions, inactions, or negligence, but also from the actions, inactions or negligence of others, the conditions of the premises or of any equipment used, and that there may be other risks not known or reasonably foreseeable at this time; and accepts sole responsibility for all of the hazards and risks to Participant and Participant’s property associated with or related to Participant’s participation in the Event and for any damage or injury that Participant may cause to others;

1a. All participants and spectators should self-assess whether they are well enough to attend and/or participate prior to arriving at the facility/gym/court.

2. Releases, waives and forever discharges any and all claims of damages or causes of action,including but not limited to, death, personal injury or loss or damage to property, which Participant or any of Participant’s representatives, heirs, next of kin or assignees (“Participant’s Representatives”) may have or which may hereinafter accrue to Participant or Participant’s

Representatives as a result of Participant’s participation in the Event or otherwise and which may be asserted by Participant, or Participant’s Representatives against Alberta Basketball and its respective officers, directors, governors, officials, employees, agents, sponsors, and affiliates (collectively, the “Released Entities”), whether caused by the acts, omissions or negligence of the Released Entities or by any other person or entity, including, but not limited to, any loss of collegiate or high school eligibility as a result of Participant’s participation in Event (it is recommended that, before registering for the Event, each would-be participant contact his/her coach, athletic director and/or amateur athletic governing body to ensure that such eligibility would not be affected by participating in the Event);

3. Agrees to indemnify and save and hold harmless the Released Entities and each of them from loss, liability, damage or cost they may incur due to the undersigned's participation in the Event, whether caused by the negligence of the Released Entities or otherwise.

4. Grants permission to Alberta Basketball to collect and utilize Participant’s name, voice, statements, photograph, image, likeness, actions at the Event and/or Participant’s biographical data in any live or recorded form (including, but not limited to, any form of video display or other transmission or reproduction), in whole or in part, for promotional, commercial or any other purpose, in perpetuity worldwide on standard and non-standard television, home video, print, electronic and on-line media (including, without limitation, the Internet), and in any other means of distribution, publication or exhibition, whether now known or hereinafter created without any additional consideration in connection with the Event, future Events, and the marketing, advertising and promotion thereof. Without limiting the generality of the foregoing, I hereby give permission to ABA and each of its respective officers, directors, governors, officials, employees, and agents to collect and use my contact information (being my name, address, telephone number and e-mail address) to communicate with me about upcoming ABA updates, programming information, etc, with the understanding that ABA will not share any of the above mentioned information with Event sponsors and corporate partners to receive exclusive offers and special opportunities from such sponsors/suppliers/advertisers.

Personal information collected by ABA from you is collected under the authority of S.32c of the Freedom of Information Protection of Privacy Act and will be used to administer program registrations, membership management, and facility bookings for Community Services. Aggregate data will be used for program planning and evaluation. Questions about the collection of personal information should be directed to the Community Services FOIP Coordinator at (780) 496-4863.

If at any time Participant would like to withdraw Participant’s consent to any future communication with ABA, Participant may do so by sending an e-mail to info@basketballalberta.ca indicating Participant’s desire to withdraw from any future communication from ABA; and if not signed by Participant’s parent or guardian above, represents that Participant is over the age of majority in the province in which Participant resides; and acknowledges that the Released Entities are relying on the grant of rights contained herein.

ABA Social Media Policy

Social media is powerfully influential and can be a positive resource to promote and celebrate the accomplishments of athletes, coaches and officials. The use of social media to discriminate, threaten, bully, insult or put down others will not be tolerated. Purpose - This policy provides guidance for Alberta Basketball employees, contractors or volunteers who contribute or reply to posts on social media. “Social media” in its broadest form includes, but is not limited to, facebook, twitter, instagram, youtube, blogs, electronic newsletters, online forums and other sites and services that permit users to share information with others in a contemporaneous manner. Principles - The following principles apply to the professional use of social media on behalf of Alberta Basketball as well as personal use of social media when referencing the ABA or its employees, members, partners, sponsors or other stakeholders (“Stakeholders”).

1. Users should be aware of the effect their actions may have on Alberta Basketball’s image as well as their own. Posted or published information may be public for a long time.

2. Users should use their best judgment in posting material to ensure that it is appropriate and not harmful to Alberta Basketball or its Stakeholders.

3. Prohibited social media conduct includes posting content, commentary or images that are proprietary, defamatory, libelous, pornographic, salacious, sexist, racist, harassing, or that can create a hostile work environment.

4. Users are not to publish, post or release any information that is considered confidential or not public.

5. If encountering a social media situation that threatens to become antagonistic, users should disengage from the dialogue in a polite manner and seek advice.

6. Users should obtain appropriate permission before referring to or posting images of current or former Stakeholders.

7. Users should obtain appropriate permission to use a third party’s copyrighted material, trademarks, service marks or other intellectual property.

8. Subject to applicable law, personal online activity that violates Alberta Basketball’s Social Media Policy or any other ABA policy may subject an employee to disciplinary action, which may include termination.

9. If users publish content on personal social media accounts that involves work or subjects associated with Alberta Basketball, a disclaimer should be used, such as: “The postings on this site are my own and do not necessarily represent Alberta Basketball’s positions, strategies or opinions.”

10. It is highly recommended that users keep ABA-related social media accounts separate from personal accounts. Those with access to ABA social media accounts are not to share passwords or change login information credentials without permission.

11. When in doubt, don’t post. At the end of the day, users will be responsible for what they share through ABA social media channels. Exercise caution and common sense.
